statue of limitations for bad debt
Where can I find information indicating how long the utilities have to collect a bad debt?
They send a letter my mother 16 years and I feel they should. What is the statue of limitations for such things in the state of Florida? Someone please help ..
Utility bills n DIFFER then any other debt, and rules are SOL. In Florida, is considered an "open" contract, and the ground is 4 years. See the link below. Note, however, that the utility will keep the debt on their records and will not allow you to obtain their services again. If they are still harassing you, it depends on who is doing it. The original creditor is not under the rules of the Fair Collections Act debt, so they can do almost whatever they want. If it is a collection agency attorney or collection, just send them a "cease and desist" letter and they will force to stop bothering you. This debt can not be placed on your credit report or, if you may want to check it out to ensure they were not looking to make there.
